Welcome to Zen’n’ish® | Loam Kaya™ of Integrative Psychotherapy & Wellness (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your use of our website(s), content, and services, including ZenLoam™ by Zen’n’ish® courses and related offerings (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
1) Who We Are
Zen’n’ish® | Loam Kaya™ provides psychotherapy and wellness education. We may also offer workshops, speaking, podcast content, sound based experiences, Reiki, retreats, courses, and digital resources.

2) No Emergency Use
Our website, email, text, DMs, forms, and voicemail are not for emergencies.
If you are in crisis or may harm yourself or someone else:
Call 911 (U.S.) or your local emergency number.
Go to the nearest emergency department.
You can also call or text 988 in the U.S. for the Suicide and Crisis Lifeline.
3) Clinical Services, Licensure, and Where You Are Located Matters
Psychotherapy is regulated by state law. You must be physically located in a state where your clinician is authorized to practice at the time of service. (In telehealth, the client’s physical location controls.)
Dr. KiKi provides therapy only where properly licensed or otherwise authorized, including:
South Carolina
Illinois
Vermont (telehealth)
Idaho (telehealth)
If you travel or relocate, you agree to inform us before any session. We may pause or end services if we cannot legally continue in your location.
4) Telehealth Specific Terms
If you participate in telehealth:
You agree to provide your current physical location at the start of sessions when requested.
You agree to provide a valid emergency contact (and update it as needed).
You understand telehealth has benefits and risks (including technology failures and privacy limits).
You agree to use a private space and reasonable safeguards (headphones, secured Wi-Fi when possible).
If there is a disruption, we will follow the backup plan described in your intake and consent documents.
5) Informed Consent and Separate Clinical Paperwork Controls
For psychotherapy clients, your informed consent, financial agreement, telehealth consent, privacy practices, and practice policies are provided during intake. Those documents may include additional terms that control your clinical relationship.
If anything on the website conflicts with signed clinical paperwork, the signed paperwork controls.
6) Wellness Services, Reiki, Sound Therapy, Retreats, and Workshops
Some offerings are educational or wellness based and are not psychotherapy. These may include sound based experiences, sound grounding, Reiki, retreats, intensives, workshops, and courses.
Unless we have a signed therapy agreement:
These services are not a substitute for medical care, psychiatric care, or emergency services.
We do not diagnose medical conditions or guarantee outcomes.
You are responsible for checking with your medical provider when appropriate.
Assumption of Risk:
You understand that participating in movement, breath, sound, and wellness experiences may involve normal risks (emotional activation, dizziness, discomfort, fatigue). You agree to stop if something feels unsafe and to seek appropriate medical support when needed.
Special note for sound:
If you have a history of seizures, severe sound sensitivity, vertigo, significant cardiac concerns, or are pregnant, please consult your clinician or physician and inform us prior to participation.
7) Educational Content, Courses, Speaking, and Podcast Disclaimer
Our blogs, downloads, courses, workshops, guest speaking, media, and podcast content are for general education. They are not a substitute for individualized mental health treatment, diagnosis, or medical advice.
If you need personalized care, please book a consultation or seek a licensed clinician in your jurisdiction.
8) Accounts, Purchases, and Payments
If you purchase a course, workshop, or digital product, you agree to provide accurate information and use payment methods you are authorized to use.
We may use third party platforms (payment processors, course platforms, scheduling systems). Your use of those services may also be governed by their terms.
9) Refunds and Cancellations
Refund and cancellation policies are posted at checkout or in your service agreement. If no written policy is provided for a specific offering, then:
Digital products: generally non refundable once access is delivered.
Courses and workshops: transfer or credit may be offered at our discretion when appropriate.
Retreats: may have stricter deadlines due to venue costs.
10) Privacy
We take privacy seriously. Our Privacy Policy explains how we collect and use website information. If you become a psychotherapy client, you will also receive our HIPAA Notice of Privacy Practices describing how protected health information is used and disclosed. (Those are separate documents from these Terms.)
11) Intellectual Property
All website content, course materials, worksheets, graphics, videos, audio, and written content are owned by Zen’n’ish® | Loam Kaya™ or used with permission and are protected by intellectual property laws.
You may not copy, reproduce, distribute, sell, or create derivative works without written permission, except for personal, non commercial use as explicitly allowed in a purchase license.
12) Acceptable Use
You agree not to:
Use the site for unlawful purposes.
Attempt to hack, scrape, disrupt, or reverse engineer the site.
Upload malicious code.
Post content that is threatening, harassing, or violates another person’s rights.
We may suspend or block access to protect the site and community.
13) User Submissions
If you submit comments, messages, testimonials, or other content:
You confirm you have the right to share it.
You grant us permission to display it as needed for the intended purpose.
For testimonials, we will obtain written permission before using identifying information in marketing.
14) Third Party Links
We may link to third party websites or tools. We do not control them and are not responsible for their content, security, or policies.
15) No Guarantees
We do not guarantee results. Healing and growth are influenced by many factors. Any examples or stories are illustrative, not promises.
16) Limitation of Liability
To the fullest extent permitted by law:
We are not liable for indirect or incidental damages arising from use of the website or educational content.
Our total liability for any claim related to a paid product is limited to the amount you paid for that product.
Some states limit these exclusions, so parts of this section may not apply to you.
17) Indemnification
You agree to indemnify and hold us harmless from claims arising from your misuse of the Services, violation of these Terms, or infringement of third party rights.
18) Dispute Resolution
If a concern arises, you agree to contact us first to attempt informal resolution.
If unresolved, disputes may be handled through:
good faith negotiation, then
mediation, and if needed,
a court of competent jurisdiction.
19) Governing Law and Venue
These Terms are governed by the laws of South Carolina, without regard to conflict of law rules. Venue will be in Horry County, South Carolina unless otherwise required by law.
20) Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a new effective date. Continued use of the Services means you accept the updated Terms.
